What are Mediation and Arbitration?

Mediation and Arbitration also called Alternative Dispute Resolution ("ADR"), is a means of settling your case or dispute efficiently and economically by using a mediator or arbitrator.

 

  • Who is a Mediator? - A neutral person, often a lawyer, who helps the parties communicate, clarify facts, identify legal issues, explore settlement options and agree on a solution that is acceptable to all sides. If you can not agree on a resolution, the matter continues.

 

  • Who is an Arbitrator? - A neutral person, often a lawyer, who hears arguments and reviews supporting evidence from each side and then issues a decision on the outcome. When the parties want someone other than the Court or themselves to decide the issue, they can seek the assistance of an arbitrator. The arbitrator's decision can be binding or non-binding. Arbitration is less formal than a trial, and evidence rules are often relaxed.
     

What Are The Advantages Of Using Mediation or Arbitration?
  • Faster - litigation can take years to complete, but ADR can occur in weeks or months.

  • Less costly - parties can save money on attorneys' fees and litigation costs.

  • More flexibility - parties choose the ADR process appropriate for their case.

  • Less stressful - in mediation parties cooperate to find a mutually agreeable resolution. In arbitration, the arbitrator will decide, and the decision can be binding or non-binding.

  • Settle your case - a mediator can help you effectively communicate your interests and your adversaries' point of view to find a means to settle your dispute. An arbitrator's ruling can help you determine the strengths or weaknesses of your case.
